Karnataka: Reservations for the transgender community in all govt services

In all government services, Karnataka has become the first state in the country to grant 1% reservation to the transgender population. The government submitted a report to the High Court in this respect, notifying that a notification had previously been issued after revising the Karnataka Civil Service (General Recruitment) Rule, 1977. On 6 July, the Final Notice outlines the reservation of 1% for the third gender in general and the reservation categories. Inviting applications for government positions must be included in an ‘other’ column along with male and female columns whenever a notification is released. The statement further emphasizes that there should not be any discrimination against transgenders in the process of selection.

On July 20, the case was heard by a High Court Divisional Bench led by the Chief Justice. The announcement states that if transgender candidates are not available, the position may be offered to people from the same category. An NGO, ‘Sangama,’ filed a Public Interest Litigation (PIL) in the High Court challenging the denial of job chances in the State Special Reserve Constable Force and Bandsman posts.

The government’s public prosecutor informed the bench that the administration has implemented a 1% horizontal reservation in government recruitment by amending the current regulation. A petition from the ‘Jeeva’ NGO was presented by Jayna Kothari, a renowned attorney, who stated that the current amendment permitted the third gender in government services. The court, on the other hand, should issue directives to guarantee those job possibilities in various boards and businesses are available.
